Terms and conditions of sale and use

Last update: October 8, 2026

Welcome to Guardty. These Terms and Conditions (the "Terms") govern access to and use of our online store and our site (the "Services"), as well as all purchases made from us. Guardty is hosted on Shopify. Please read these Terms carefully.

1. Seller and Scope

The seller for all orders is Seroume LLC, 30 N Gould St Ste R, Sheridan, WY 82801, USA – email: contact@guardty.com (further details in the Legal Information).

These Terms apply to all visitors, users, and customers of the Services, in the version in effect at the time of the order.

We may amend these Terms for the future. The updated version is published on this site. For contracts already concluded, the version in effect at the time of the order applies.

2. Use of Services

By using our Services, you declare that you are of legal age or that you are using them under the supervision of a parent or guardian. You agree not to use the Services for illegal or unauthorized purposes and not to engage in acts that may impair, disrupt, or damage the operation of the Services. We reserve the right to deny, restrict, or terminate access to the Services in the event of a violation of these Terms.

3. Products and Availability

We strive to represent our products – clothing, fashion, and accessories – as accurately as possible, as well as their related colors, descriptions, and prices. Slight color differences due to your device's screen settings are possible. All products are available while supplies last. We may change or discontinue a product offering at any time; orders already accepted are not affected.

4. Prices and Payment

All prices are indicated in the currency shown on the site and include statutory VAT, where applicable. Shipping costs are indicated separately before the conclusion of the order. The price shown at the time of the order is binding. Payment is made at the time of the order via the payment methods indicated at checkout. By transmitting your payment data, you confirm that you are authorized to use the chosen payment method.

5. Conclusion of Contract and Language

The presentation of products on the site does not constitute a binding offer. By clicking the order button, you submit a binding purchase proposal. After sending the order, you will receive a confirmation email with which we accept your order, and the contract is considered concluded.

We may refuse an order before acceptance for legitimate reasons, particularly in cases of suspected fraud or product unavailability. In such a case, we will refund any amounts already paid without delay.

The language of the contract is Italian. The contract text is stored by us and sent to you via email along with the order confirmation.

6. Shipping and Delivery

Processing and delivery times and shipping costs are indicated in our Shipping Policy. Pursuant to Art. 61 of the Consumer Code, we deliver the order within 30 days of the conclusion of the contract, unless otherwise agreed. Pursuant to Art. 63 of the Consumer Code, the risk of loss or damage to the goods transfers to you only when you physically enter into possession of the goods.

7. Right of Withdrawal, Returns, and Refunds

As a consumer, you have the right to withdraw from the purchase within 14 days of receipt of the goods, without having to provide any reason (Art. 52 et seq. of the Consumer Code). We also offer a voluntary right of return of 30 days from receipt of the goods, which does not affect your legal rights. Details on returns, exchanges, and refunds, as well as the standard withdrawal form, are indicated in our Return and Refund Policy.

8. Legal Warranty of Conformity

Pursuant to Art. 128 et seq. of the Consumer Code, products are covered by the legal warranty of conformity for 2 years from delivery. In the event of a lack of conformity, you are entitled to have the goods brought into conformity through repair or replacement, free of charge and, under legal conditions, to a price reduction or termination of the contract. To assert the warranty, contact us at contact@guardty.com.

9. Intellectual Property

All content of the Services, including text, graphics, logos, images, product designs, and software, is the property of Guardty or our licensors and is protected by applicable intellectual property law. You may not copy, reproduce, distribute, or use for commercial purposes the content of the Services without our prior written consent.

10. User-Generated Content

If you post content on the Services, such as reviews or comments, you grant us a non-exclusive, free right to use, reproduce, and display such content in the context of managing the Services. You are solely responsible for the content you post and warrant that it does not infringe on the rights of third parties and is not illegal, offensive, or inappropriate. We reserve the right to remove content that is illegal or contrary to these Terms.

11. Liability

We are liable without limitation in cases of intent and gross negligence, as well as in cases of injury to life, physical integrity, or health and in cases provided for by product liability legislation.

For simple negligence, we are liable only in the event of a breach of essential contractual obligations and within the limits of foreseeable damage typical of the contract. Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted by law, particularly with respect to mandatory consumer rights.

12. Links to Third-Party Sites

The Services may contain links to third-party websites. Their respective operators are solely responsible for their content. Access to such sites is at your own risk.

13. Applicable Law and Jurisdiction

These Terms are governed by Italian law, excluding the Vienna Convention on the International Sale of Goods.

For disputes with consumers, the court of the place of residence or elective domicile of the consumer has exclusive jurisdiction, pursuant to Art. 66-bis of the Consumer Code. If you habitually reside in another EU Member State, the mandatory provisions protecting consumers in your country of residence remain unaffected.

We are neither obligated nor willing to participate in out-of-court dispute resolution procedures before a consumer arbitration board.

14. Severability Clause

The possible invalidity of a clause in these Terms does not affect the validity of the remaining provisions.
